Why a Performance Solution can solve your problem:

If a Deemed-to-Satisfy (DtS) cannot be applied to your issue a Performance Solution prepared by a suitably qualified person may be able to provide you with an NCC compliant alternative.

When should I get a Performance Solution:

You must get a PS before the works have been constructed. The design phase of works is the best time to get a PS. If construction has commenced, a performance solution can still be obtained, as long as that part of works is not constructed until after the PS has been approved by the RBS.
